Probation / Parole:

Probation is an alternative to incarceration. Criminal defendants who receive probation as a sentence will be able to remain members of their community, without seeing the inside of a jail or prison, so long as they follow rules set by the court. These rules may require them to seek counseling or treatment, participate in community education or perform community service. They will also be required to attend regular meetings with their probation officer, which involves random drug testing. If they break any of these rules, their probation can be revoked, and they can be sent to jail or prison. The goals of probation include:

- Allowing the offender to remain in the community to maintain family ties and employment.
- Providing the offender with guidance from the probation officer and access to community-based treatment programs
- Helping the offender become a productive member of society
- Protecting the interests and well-being of the public by providing supervision and treatment to offenders

Violations of Probation, even for technical or minimal violations are always serious because Violators of Probation are not entitled to bail pending hearing, and often sit in jail for months waiting for the opportunity to explain an unintentional or immaterial violation, which is then dismissed.

While a Defendant has no right to bail in a Violation of Probation, a court does have discretion to grant same, and a skillful, experienced lawyer is always crucial in these cases for this reason alone.
