Domestic Violence:

Domestic abuse and violence has been the subject of intense scrutiny by the Florida legislature for the past fifteen years. Like DUI, domestic violence laws have been revised almost annually, always to the benefit of the state and public policy and with little or no thought for the rights of the accused or their families. One of the most recent revisions resulted in mandatory jail sentences in domestic violence cases. Only an aggressive and skillful defense strategy can stop the state from imposing the same draconian results in every case, without regard to the wishes of the victim or fundamental fairness. A variety of offenses may fall under the general category of domestic violence, including:

- Assault
- Battery
- Child abuse
- Elderly abuse
- Kidnapping
- Sexual assault
- False imprisonment
- Harassment
- Stalking

Restraining orders, protective orders, and no-contact provisions as a condition of pre-trial release also factor into the equation. Increasingly over time, law enforcement has developed new policies of zero tolerance, i.e., if there is a call involving domestic violence, someone is going to jail. The court system has implemented far-reaching changes denying bond or imposing no contact conditions of release, thereby separating families for the months usually required to resolve these cases. Prosecuting attorneys have taken an active role in strictly enforcing both new and existing domestic violence laws. Only the most skillful and sensitive approach will avoid the cookie cutter sentencing approach that the state likes to see. Take the time to meet with Mr. Horneffer to discuss the individual facts and circumstances of your case. He can outline all of your options and help protect your rights and those of your family by moving to set aside no contact provisions and insuring that the State gives proper weight to the victim's wishes.
